Tower contractor sues UON over Sh237m claim

The University of Nairobi is facing a Sh237 million claim from a quantity surveyor hired by the leading varsity during construction of its Sh2.3 billion tower.

According to the suit filed by the surveyor Songa Ogoda & Associates, this has added to the many financial woes that are  facing the institution which include a Ksh193.8 million arbitral award plus accrued interest on the overdue debt.

“That the honourable court be pleased to adopt as a judgement of the court capable of enforcement in execution the final arbitral award dated November 24, 2017 in favour of the applicant for the sum of Ksh193.8 million with simple interest thereon at 14.5 per cent per annum from December 2017 to date,” says the surveyor in court papers.

According to the documents filed by the surveyor in court on January 8, 2019 , there is tabled claims that the UoN had put up a robust defense before the tribunal . It is not clear as to why it did not appeal against the arbitrators’ decision .

The firm is now asking the court to enforce the award since it has not been challenged.

The university has been facing financial hardships, with a current debt of over Ksh1.6 billion unremitted pension and statutory deductions for its workers.
