Learned thief!city lawyer charged for stealing millions from client

A Nairobi lawyer accused of stealing millions from his client has been charged.

Simon Shivaji was accused of making away with Kshs6.5 million that belonged to his client Nelly Mutua.

The lawyer reportedly received the disputed amount between the months of March and July of 2015.

As a lawyer, Shivaji, 43, had been mandated to receive the amount deposited by a buyer of a plot in the city and then remit it to the account of his client.

Shivaji, reportedly, in the South C land deal, accepted the payment posing as Mutua’s agent.

The buyer deposited the money in two instalments but it was never transferred to Mutua’s account.However, the lawyer only sent a copy of an application to transfer the cash to the account of the complainant.

Appearing before resident magistrate Hellen Okwami, however, Shivaji denied the accusarion and appealed for reasonable bond denied the accusation and appealed for reasonable bond terms.

“My client cannot raise a high amount in cash bail or bond since he is not earning anything. He has no means of raising money as he cannot practise,” stated Shivaji through his lawyer Polycarp Ongwae.

Court awarded him a Kshs800,000 cash bail or a Kshs1.5 million bond to secure release from police custody.
