QC Khawar dismisses claims that DCJ Mwilu was fixed

As the Deputy Chief Justice Philomena Mwilu’s case continues Queen’s Counsel Khawar Qureshi has dismissed claims that her corruption charges are political affiliated.

This was after a five judge court ruled that the charges of corruption against her were more political instigated.

According to QC Khawar who is representing the DPP, “There is simply no basis, rhetoric aside, to assert that DPP’s decision was done by improper consideration.”

In addition he said, there was no concrete evidence that had been raised by Mwilu’s lawyers to prove that her case is framed.

He further said that the DCJ’s petition lacked facts and should be dismissed.  

He maintained that the DPP followed the law in preferring charges against the DCJ and the decision reached was purely based on evidence, law and public interest.

The defence team has, since Qureshi’s appointment, complained that he was unlawfully appointed. Mwilu unsuccessfully sought to bar him from prosecuting her fraud case.

The hearing resumes today.
