Four suspects who had been charged with the Westgate shopping Mall attack were to have been given a ruling on a Thursday December 20th but the case was scheduled to January 14th as the Magistrate Francis Andayi was not ready to give a verdict then.
One of the four suspects charged in connection with the 2013 Westgate Mall attack in Nairobi was on Monday acquitted as the court ruled that three of his co-accused have a case to answer.
Adnan Ibrahim who was captured on CCTV camera in a bank paying for the car that was used in the attack has been acquitted on the grounds that evidence presented in court proves Adan Dheq wasn’t involved in the terror activity.

However three of the four suspects still have a case to answer.

Delivering the ruling on whether the four had a case to answer, Chief Magistrate Francis Andayi said the prosecution has established a prima facie case against three of the accused.
The three with a case to answer are Ahmed Abdi, Liban Abdullah and Hussein Mustafa, while the freed suspect is Adnan Ibrahim.
They are also charged with aiding terrorist groups and being in Kenya illegally.
