DPP Haji Rubbishes Bias Claims Saying He cannot Manufacture Evidence in Murder Case

Director of Public Prosecutions Noordin Haji is a man on the spotlight because of the nature of his job. The Chief Public Prosecutor has again a topic of discussion after his in depth interview on Citizen TV last night.

The DPP was put to task to clear the air on a number of cases that his office is handling. Apart from Governor Okoth Obado and DJC Philomena Mwilu cases, the DPP was put to task to set the record straight on the attempted murder claims that have been labelled against Garissa governor Ali Korane.

For a period of time now, the DPP’s office has been accused of biased in the manner in which it has handled the said case.

The family of Idris Mukhtar, former Garissa County official who is fighting for his life after he was shot in the head accused the Director of Public Prosecution (DPP) and the Director of Criminal Investigations (DCI) of not investigating the case further.

Aden Mukhtar, the father of Idris Mukhtar, while addressing the media at Milimani Law Courts last month, said the former Garissa County Finance CEC was flown to India for further specialised treatment but lamented on the investigations taking long.

“We do not have faith in the DCI, he has been influenced by some politicians,” said Mr. Muktar.

DPP Haji has now come out to rubbish claims of failing to act in the case.

Speaking during an interview on Citizen TV’s News Night, Haji insisted that his decisions on cases are purely based on evidence and not on individual bias.

“I cannot manufacture evidence, it has to come from the DCI who is the person in charge of investigations,” said DPP Haji.

Mukhtar, the former Garissa Finance executive, was shot on August 19, 2018 at White Star Restaurant along Kandara Road in Kileleshwa, Nairobi.

On Tuesday evening, the DPP responded to claims that he is a family friend to the Garissa Governor and this may have altered the intensity of investigations.

Haji acknowledged that Korane is indeed an acquaintance but was categorical that it is not of consequence since he took an oath that pledges justice for all.

“I have said it very clearly, when it comes to murder I will not entertain it and the law has to take its course. When the file is brought to me, I will take the appropriate action based on the evidence that I have before me,” Haji said.

Mr. Mukhtar, Idris’ Father has constantly pointed fingers at Garissa Governor Ali Korane over the shooting,  he even filed a petition seeking to have him removed from office on the grounds that he has fake certificates.
