Deputy Chief Justice Philomena Mwilu was arrested last week at the Supreme Court and taken to DCI headquarters for questioning over alleged graft.
Mwilu was arrested in a crackdown at the Supreme Court over allegations of financial impropriety.
According to the Director of Public Prosecutions Noordin Haji Lady Justice Mwilu will be charged with abuse of office, receiving bribe and failing to pay taxes.
The DCJ was arraigned in court and released on Sh5 million bond.
However Kenyans feel it is just for DCJ Mwilu to step aside as she allows investigations to take place.
