DCJ Mwilu’s son dragged in to mother’s corruption case

Deputy Chief Justice Philomena Mwilu  Son Timothy Mutunga has been dragged into his mother’s corruption allegation.

In an affidavit, the senior detective from the Directorate of Criminal Investigations  has revealed that Mwilu’s son, Timothy worked at Imperial Bank  as a Quality Assurance officer and was used to liaise communication between the bank and the DCJ who at the time was a judge at  Court of Appeal.

In the replies, the DPP, together with his counter part Directorate of Criminal Investigations (DCI) have sought  to convince the court that the DCJ’s relations with Imperial Bank were unprofessional and unethical.

Following DCJ Mwilu’s allegation that President Uhuru Kenyatta was motivated to remove her from the office has been decline by both the DCI and the DPP where they have argued to  sufficient evidence of criminal conduct on the part of the Supreme Court judge.

According to senior prosecuting counsel Lillian Ogwora, “To quash the proceedings as prayed by the petitioner would amount to impeding the DPP from performing his constitutional and statutory duties,”

In addition she said, “Having reached an independent decision to prosecute, the DPP should not be vilified without any justifiable cause.”

The Director of Public Prosecutions Noordin Haji has defended the decision to arrest and prosecute Deputy Chief Justice Philomena Mwilu over corruption allegations.
