Choice of words have always been said to be very crucial as it can land one in trouble.Who would have thought a respected judge would be on this bench?
Its a hit back as Wakiaga’s ruling on Jowie and Jacque bail hearing leaves his integrity and intentions on question by Kenyans who no longer trust the judge to give justice on the murder case of Monica Kimani.
“A picture that emerges from the prosecution’s evidence as set out herein above and the pre-bail report of the accused is that he is a male version of a slay queen, which for lack of better terminology I’d call a woman eater,” said the judge as he rejected Mr Irungu’s bail application.
Angry KOT have expressed their concerns and distress by suggesting that Justice Wakiaga should excuse himself from the case as it looks like their is a bone of contention in the case.

I struggle to understand Justice Wakiaga’s approach in delivering his ruling and won’t be surprised if there is an application for recusal.

Citizen Television journalist Jacqueline Maribe has been freed while her co-accused Joseph Irungu will stay in remand after being denied bail.
The High Court denied Mr Irungu’s request for bail in the murder of businesswoman Monica Kimani, with Justice James Wakiaga ruling that he is a flight risk and has access to weapons that can intimidate witnesses.
The first thing Jowie should have his lawyer do is to make an application to have Justice Wakiaga disqualify himself from hearing this matter. The Judge by labeling Jowie a slay queen woman water at this point reeks of a mind that has a predetermined outcome.

The judge said the prosecution failed to table before him compelling reasons to deny Ms Maribe her freedom and in ruling of bail asked the TV journalist not to contact any of the witnesses, either directly or indirectly.

The Hon. Mr. Justice Wakiaga used words that are easily understandable to the Public. If they are not what we are used to from Judges it is because for too long Judges spoke as though they are sitting in Chelsea not Milimani

In addition, Ms Maribe will also accompany investigators to her house in Lang’ata, Nairobi, so they can make an inventory or gather any evidence they haven’t got. Thereafter, they will allow her to use the house.

Justice Wakiaga also barred Ms Maribe from reading news or interviewing any person related to the case during the trial period but the order will be reviewed regularly.
