President Uhuru Vs CJ Maraga: President Becoming a Dictator?

On June 8, 2020, Chief Justice David Maraga issued a public statement lamenting on how the Executive is making it hard for the Judiciary to perform its duties.

CJ Maraga accused President Uhuru Kenyatta of undermining judicial independence, and ignoring court orders.

“Unfortunately, this disregard of court orders by the president is part of the pattern by the Executive… It greatly undermines the Rule of Law for the Government to act in defiance of court orders; and this pattern puts at great risk our constitutional democracy because it risks the contagion of lawlessness”, CJ Maraga said.

Attorney General Kariuki Kihara defended the president saying that the Head of State would not be forced to appoint judges with tainted records.

President Uhuru has also been accused of controlling the Legislature, which should be a an independent arm of government.

He defended himself saying that he will only work with people who support his agenda for the nation. As the Jubilee party leader, he approved the removal of several legislators from key positions in the Senate and National Assembly.

Elgeyo Market Senator Kipchumba Murkomen, who was recently ousted as Senate Majority leader, has openly faulted the president’s leadership style of late.

“Mr. President, legacy is the sum total of what you do everyday, not a coat you pick and wear end of term. Obey court orders and rule of law. It’s not you alone who wants a good legacy; CJ, elected leaders, civil servants, hustlers all want good legacy. Don’t make everything to be about yourself”, he said.
