Governor Waititu Suffers Another Blow in Court

Kiambu Governor Ferdinand Waititu has suffered another blow in court after the Court of Appeal upheld Justice Mumbi Ngugi’s ruling that barred governors accused of corruption from accessing office.
The ruling also affects Samburu Governor Moses Lenolkulal and Nairobi’s Mike Sonko.
Lenolkulal and impeached Waititu, on Friday, went to the Court of Appeal in Milimani, Nairobi for the ruling on access to their offices.

High Court Judge Mumbi Ngugi on July 24, 2019, ruled that governors facing corruption charges should step aside until their cases are concluded.

The two are facing corruption charges.

Lenolkulal was arrested in April over suspected Sh84 million fraud at the county.

He was picked up from his Nairobi home at dawn and driven to the Ethics and Anti-Corruption Commission offices over conspiracy to commit an economic crime.

Chief magistrate Lawrence Mugambi had earlier on gave the order against Waititu following a precedence set by Judge Ngugi that directed Lenolkulal not to step in his office unless authorised by anti-graft agency CEO Twalib Mbarak.

The magistrate stated that barring Waititu from office did not amount to removing him from office but was meant to protect the integrity of the court process.

In today’s (Friday) ruling,  the Appellate judges maintained that elected officials should not access their offices until their cases are heard and determined.
