The Football Kenya Federation Disciplinary Committee has cleared the federation CEO Robert Muthomi of charges leveled against him in August.

In a dramatic case which put the FKF CEO at the centre when he was accused of tapping a player in John Avire and misusing his powers as the federation official, Muthomi was taken to the disciplinary committee for further investigation. During that period, he was forced to step aside from his position until a conclusive report is availed.

But, in a 13-page report dated October 18, the disciplinary Committee has expressed its concerns over Muthomi’s conduct but cleared him of any charges for lack of substantial evidence.

“The Committee received a bundle of documents as regards this matter on the 14th of August, 2019 and the matter was subsequently set down for hearing and heard in full on 30th September, 2019.

“Having considered all the evidence laid before it, the Committee is of the view that in the broad sense there was insufficient adduce evidence to the effect that the Respondent abused his office.

“In conclusion, the Committee holds that despite the fact that there was no brazen evidence of abuse of office, there were certain ethical concerns on the Respondent’s part in the general handling of the matter.

“The Committee hopes that the Federation will take this ethical concern into consideration in any discussions with the Respondent and the staff at the Federation generally. The decision of the Committee is unanimous,” the report read in parts.

In the report, the federation has also been advised to strengthen its systems so as to block any loopholes.

Only time will tell whether FKF will reinstate him as the CEO or Barry Otieno, who has been acting since then will remain on the seat.
