Big win for Mp Osotsi as Muturi Rejects His Expulsion from ANC

Embattled nominated MP Godfrey Osotsi can now breath a sigh of relief after the National Assembly Speaker Justin Muturi said the decision to kick him out of parliament by ANC party was not done according to the Constitution.

In a letter dated April 3, the speaker through the clerk of the National Assembly Michael Sialai, maintained that he was unable to act on the party’s earlier letter urging him to terminate the nomination of Mr. Osotsi.

The same letter faced defeat when the Independent Electoral and Boundary Commission (IEBC) rejected ANC’s move to have Osotsi ejected from parliament.

“Accordingly, the party now considers the present list obsolescent and would wish to resubmit a reviewed list for future consideration, in line with 37(2) of the Election Act,” read a section of ANC’s letter to the IEBC concerning the issue.

The commission was not convinced beyond reasonable doubts that the details given by ANC for Osotsi’s expulsion met the merits hence told off the party, citing illegality and in the process upholding Osotsi’s nomination.

In a letter to the ANC, IEBC Chair Wafula Chebukati says he would only effect  changes to the list of nominees  as required by ANC only if the party  showed the commission that there were sufficient grounds to remove the vocal nominated MP. adding that the  list of 98 people nominated by the party in 2017 would be valid until 2022 unless for reasons provided by the law.

Osotsi who was nominated in 2017 on an ANC ticket was on mid-March this year kicked out of ANC party under unclear circumstances and was at the verge of losing his parliamentary seat.

ANC Secretary General Barrack Muluka had earlier on notified the Speaker of National Assembly Justin Muturi and Clerk Michael Sialai over the move to kick out the MP from the august House.

The decision to expel Osotsi is linked to an audit of the party’s funds during the last polls that revealed that Sh56 million could not be accounted for. Sources intimate to his expulsion, however, indicated that Osotsi was expelled due to his close relationships with ODM party leader Raila Odinga.

 

After the party’s announcement to kick him out, Osotsi accused the party of engaging in a political witch-hunt, stating that the audit query was yet to be concluded by the DCI.

This is the second time the party is suffering a setback in its move to expell Osotsi.

The Registrar of Political Parties had also earlier rejected the request for expulsion questioning the procedure used by the party to expel Osotsi.
