Drama!…Rape victim of allegedly Kisii MCA refuses to issue baby DNA sample

Any crime involving power has very big impacts in terms of making headlines and the fall of the accused or the fall of the victim which in the end will always turn out puzzling with intriguing details due to those involved.

In current risen politician involved crime, a huge twist has taken place in the case where Member of the County Assembly of Kisii Evans Makoro was accused of raping and impregnating a 16 year old woman in June 2016.

The victim has now filed an affidavit at the Ogembo Law Courts, asking the court to drop the charges against the ward representative.

In her affidavit dated May 11, 2019 and addressed to the Resident Magistrate, Ogembo Law Courts, the woman says: “I have learnt that Hon. Evans Omwansu Osoro has been charged for allegedly defiling me. I wish to have those charges withdrawn and terminated because I am not the complainant.

The Kisii MCA was charged with defiling the girl, three years ago. Moticho ward denied the offence said to have happened between June 2016 and June 2017 in Nyamarambe, Gucha South sub-county.

Resident magistrate Denis Mikoyan freed him on Sh 50,000 bail until May 16 when the hearing would start.

Despite medical reports showing that the woman was raped on the said dates – between June 2016 and September 2017, she denies being a sexual victim of the MCA.

“As a mother of the child, I know who his father is and I have not asked the DCIO Nyamarambe, my mother and [South Mugirango MP] Hon. Silvanus Osoro, who is funding my mother in this case, to find out for me who the father of my child is.

“I want those charges withdrawn and the DCIO Nyamarambe be ordered to return to me my child that he snatched from me, so that my child can continue breast-feeding,” says the alleged victim in her affidavit.

The woman further says she won’t give consent to authorities to extract DNA samples from the child in a bid to establish who his father is.

“… I will deem it a breach of my privacy and that of my child and our dignity and I will challenge it in court,” said the alleged victim.

The woman’s affidavit was sworn before Ogari Advocates & Commissioner for Oaths in Kisii County.

Senior State Council Peter Wainaina had requested the court to allow the child and the suspect be subjected to DNA tests. The court also added that the child be presented before it.

If convicted of defiling the then Form Three girl, the second term MCA will be jailed for 15 years.
