Grief as Court Refuses To Acquit ‘Innocent Man’ After Victim Admits Framing

It was grief upon grief when an appeal court refused to acquit a man whose daughter admitted to framing him on trumped-up rape allegations.

Mr Wambua Musyoki has been in prison following a case filed bu=y his wife that he had raped his own daughter.

Musyoki, who has maintained innocence, got a major shot in the arm when her daughter decided to recant her testimony.

However, a three-judge bench led by Justices William Ouko, Wanjoru Karanja and Jamila Mohammed refused to admit Musyoki’s daughter’s confession in court.

The judges claimed that the application was time-barred and that it would set a bad precedent, giving victims a lee-way to file crucial evidence.

While Musyoki argued that the victim had recanted her evidence, the courts would take none of it.

Musyoki has been in prison since his conviction in 2011, and his story came to limelight after being highlighted by a local Kenyan TV station.
