Justice in justice is under spotlight after Chief Justice David Maraga has released an official statement from the Judicial Service commission(JSC) regarding the cases against judges.
The CJ stated that the petition filed against judges of the Supreme court Justice Njoki Ndung’u and the Justice Ojwang by lawyer Apollo Mboya in the ruling of the case of Nick Salat had been withdrawn.
He dispelled media reports that JSC had stalled in making the decision against Justice Njoki Ndung’u.
Amidst gross misconduct controversies, Ndung’u sued the JSC to sop it from hearing and determining a complaint.
Even though justice Ndung’u had claimed that the JSC would not accord her a fair hearing, Judge Onguto ordered that the investigation should proceed as per Article 47 of the Constitution, which stipulates a fair and impartial process.
“Pending the hearing and determination of this case, the JSC is at liberty to proceed, it must comply with the law as well as provisions of fair administration and afford her a hearing before making its decision on the complaint against her,” the judge ruled.
Maraga also said that he had already responded to the petitioners who filed a case against him as the chief Justice.
