House levy graft fine that has shocked Kenyans

Many have questioned the framework and laws of regulation that will be applied to ensure Kenyans are protected from public funds looters in the House Levy Funding introduced by the government.

Well here is the law that has not gone well with Kenyans due to the controversial amount of fine that has been put in place for the offense;

Offenses and penalties; 25. A person who misappropriates any funds or assets of the Housing Fund, or assets or causes any person to misappropriate or apply the funds otherwise other than in the manner provided in these regulations, commits an offence and shall, upon conviction be liable to imprisonment for a term of two years or to a fine not exceeding ten thousand shillings or to both.

A notice in the local dailies indicated that employers are to deduct and remit the levy by the 9th of every succeeding month.

However the labour court on Wednesday issued fresh orders temporarily stopping the government from implementing the 1.5 per cent levy for the housing fund.

Justice Maureen Onyango issued the order, saying the stay order would allow the consolidation of the current case by Consumers Federation of Kenya (Cofek) with another earlier filed by the Central Organization of Trade Unions (Cotu).
