Court allows Kabogo’s property to be auctioned over debt

Former Kiambu Governor William Kabogo’s nightmares might lose his company after a Nairobi Court gave a city businessman green light to auction his property to recover Ksh 100 million.

Kabogo was ordered to pay businessman Nayan Patel Sh100 million as a fine after the politician’s company was found to have illegally occupied a parcel of land in Nairobi’s Westlands area.

The former Kiambu Governor is one of the directors of Caroget alongside his son Andrew Kamau Kabogo and sister Esther Njeri Kabogo.

Justice Elijah Obaga of the Land and Environment division, also allowed Patel to go after any property belonging to Kabogo’s son, Andrew, or his sister Esther.

This was after Patel reported to the court that he had been unable to recover the Sh100 million owed to him since he could not trace any asset owned by Caroget.

Obaga accused Kabogo of playing games after the former Governor sought to disassociate himself from Caroget.

“It has now turned out that William Kabogo Gitau was being dishonest and was out to cover Caroget from the eyes of equity.

It has also turned that Kabogo is a director of Homes & Acres Ltd, which is one of the directors of Caroget that was found to have engaged in fraudulent activities in as far as registration of the suit property was concerned,” the judged said.

Justice Obaga further gave Patel the right to apply Kabogo declared bankrupt if there will be no property to auction to assist in settling the debt.

Kabogo was quoted by the Standard saying he was not aware of the court developments but promised to challenge the ruling “all the way”.
