Sons gang up against step mother in battle for father’s estate

Two sons have now disowned their step mother amid a battle for their late father’s estate.

The sons, Edwin Otieno and Timothy Olweny in fact joined forces with their biological mother and have declared to the court that their step mother Norah Olweny was never married to their father.

The family is clearly on to something with the deceased being a former prominent Nakuru doctor, Phelesiah Olweny.

They are said to be battling a 200 million estate, and want it all to themselves.

On her part, Norah had claimed in her application that she is a widow to the deceased, having been married via Luo customary law and that she was entitled to a share of the estate.

The sons however claimed that the medic was legally married under the African Christian Marriage and Divorce Act and therefore lacked capacity to contract other marriages.

The three informed the court that they are the ones managing the estate by settling its liabilities including land rates, rent and other routine maintenance.

They said Norah is a stranger to the estate and lacks locus standi to enjoy relief she is seeking.

The matter will be heard on September 22, 25 and 30, 2019.
