Babu Owino slams judiciary over Samburu Governor’s ‘unreasonable’ bail terms

Embakasi East MP Babu Owino has today slammed the Judiciary claiming that the bail terms that were given to Samburu Governor;
Lenolkulal are unreasonable.

The MP says that Kenyans are shocked to learn of the unprecedented bail and bond terms after the presiding judge set bond at KES150 million and bail at KES100 million, figures previously unheard of in the corridors of justice.

He also added that such a ruling is definitely prejudicial and presumes guilt of the accused even before trial proceedings have even begun.

“The Constitution of our Republic states that a person is considered innocent until proven guilty. While we unreservedly support H. E Uhuru Kenyatta’s fight against corruption, we must guard against those who would subvert this fight with sensationalism and unwarranted show business.” reads his statement

Babu Owino noted that his concern is what such a ruling will mean for the ordinary Kenyan who may find themselves answering to charges of stealing a chicken, or loitering in town and are slapped with similar unreasonable terms.

He also mentioned that the judiciary must always remain the custodians of sobriety in the event of disputes in our society.

Babu Owino also called upon the DPP to focus on preparing water-tight cases instead of pursuing newspaper headlines and for the Chief Justice to rein in the judiciary’s excesses in the spirit of respect for Kenya’s constitution

The Samburu governor was arraigned at the Milimani Law Courts today and faced charges of corruption and abuse of office following his arrest this morning.

THE JUDICIARY MUST MAINTAIN SOBRIETY Kenyans are shocked to learn of the unprecedented bail and bond terms set by the courts today on Samburu Governor Moses Lenolkulal. The presiding judge set bond at KES150 million and bail at KES100 million, figures previously unheard of in the corridors of justice. Such a ruling is definitely prejudicial and presumes guilt of the accused even before trial proceedings have even began. The Constitution of our Republic states that a person is considered innocent until proven guilty. While we unreservedly support H. E Uhuru Kenyatta’s fight against corruption, we must guard against those who would subvert this fight with sensationalism and unwarranted show business. My primary concern is what such a ruling will mean for the ordinary Kenyan who may find themselves answering to charges of stealing a chicken, or loitering in town and are slapped with similar unreasonable terms. The judiciary must always remain the custodians of sobriety in the event of disputes in our society. I call upon the DPP to focus on preparing water-tight cases instead of pursuing newspaper headlines and for the Chief Justice to rein in the judiciary’s excesses in the spirit of respect for our Katiba.
