‘The rich also cry,’ Raila’s firm begs court to block the auction order

Spectre International Limited has run to court to seek an order to stop the auction of property by Betric Kenya Limited following debt worth Ksh 7 billion.

The company associated to AU Leader Raila Odinga through through their lawyer Awele Jackson now wants the court to bar Betric Kenya Limited barred from auctioning the property to recover the money.

This comes after Mombasa principal magistrate Francis Kyambia ordered Spectre to pay the fine which had remained in debt for three years.

Betric had supplied litres of fuel oil (HFO) to Spectre in Kisumu at a cost of Sh8 million between June 4 and July 18, 2016, but only Sh1 million was paid.

However Spectre denied owing Betric any money and claims that it will suffer losses if Betric is allowed to execute the court order.

According to lawyer Awele, β€œThe defendant was not aware of the existence of these proceedings and has only now, after obtaining copies of the suit papers, obtained proper and full information about the case.”

Spectre has however said that Betric failed to file any document proving the debt and that the claims are unmerited and unfounded.

In an account by the acting general manager Jacob Agoch, he only became aware of the suit through the media and that the claims in the plaint are unmerited and unfounded.

In addition he said,the advertisement notifying them was unreasonably tiny and only appeared in classified sections together with several other unrelated adverts.
