Mohammed Mohamud Sheikh, who filed a petition to remove four Supreme Court judges has surprisingly withdrawn the suit.

The Judicial Service Commission (JSC) confirmed that the petitioner had served a notice asking them to disregard all allegations set forth against the judges.
“The petitioner prays for the withdrawal of the petition dated 13th March, 2019 and disregard of the averments therein,” the new notice read in part.

Mr Sheikh had accused the judges of violating the Constitution when they heard and determined the Wajir gubernatorial election petition.
Withdrawal has little impact
The pettion, however, may have little impact on the matter that is already under consideration by the JSC owing to the fact that other parties who were enjoined in the petition have not expressed a desire to withdraw.
While speaking last week, JSC Chair Chief Justice David Maraga noted that the respondents had been given 14 days to respond.
“The petition was considered and the Commission directed that the same be served upon the named judges. They were given 14 days to respond to the issues raised therein,” he stated.

CJ Maraga is also facing a petition filed against him by one Yusuf Dimbil who accused the President of the Supreme Court of giving court instructions in his mother tongue, Kisii.
