The Court has dismissed application by former Nairobi Governor Evans Kidero to have him charged separately from 10 other accused persons, in a case in which they charged with conspiracy to defraud Nairobi City County of Sh213 million.

The prosecution argued that Kidero had not demonstrated reasons why he should face trial separately from the other ten accused persons.

State Prosecutor Jenifer Kaniu stated: “The prosecution will be prejudiced by having to call same witnesses for different trials and the facts of this case are of similar character.”

Additionally, in his application, Kidero claimed that “count 1 of conspiracy to defraud was defective”.

In a ruling on Monday, Chief Magistrate Douglas Ogoti said the charges against Dr Kidero met the threshold required by law.

He said no evidence was placed before him to convince him to interfere with the charges.

Immediately it has been noted that no one has come to the defense of Kidero claiming their people are targeted with Kenyans advising the Kalenjins to learn from the case.
