Concerns as court orders fresh probe into Nyeri’s former governor Gakuru mysterious death

While giving directions on the case on Thursday, Nyeri Chief Magistrate Wendy Kagendo ordered fresh probe of former Nyeri governor Wahome Gakuru death.

Kagendo said that the move was inevitable after Amana Africa filed a new application, in which it sought to have all the state witnesses cross-examined meaning the Nyeri residents will be forced to wait for a little longer to know exact cause of the death.

 Amana, which was a member organization for the deceased, sought to be enjoined in the case on Thursday after the case stalled following the arrest of presiding magistrate Maisy Chesang.

Chesang is currently being held by police following the mysterious death of her husband lawyer Robert Chesang’. 

The court said that there was a need for the case to kick off afresh because of the circumstances in question. 

The directive was backed by Senior Assistant Director of Public Prosecutions Peter Mairanyi. 

Mairanyi said that he needed time to cross-examine some information in the past hearing to make the case flow smoothly.

“After we adjourned in the previous hearings, I got information on which I would like to examine,” said Mairanyi, as quoted by Capital FM.

The family of the late governor has appointed Lawyer Kaari Kimathi to defend it in court. The siblings have also supported the case to start afresh as they await justice. 

The late Gakuru’s two bodyguards: Corporal Peter Mwaniki Maigua, and Corporal Samson Lekol and Personal Assistant Josphat Mwangi Maina are among those who had already testified in the inquest into the death of the former county boss.
