How Machakos Court reached a deadlock as it met Kamba traditions that allow same-sex marriage

In 2016, a resident magistrate court reached a legal deadlock where it was unable to rule divorce for two women in marriage who traditions had brought together. Josephine Ndulu, one of the party is now being chased by her husband of more than 15 years, Angela Nyamai.

Though Angela Nyamai was also married to a male husband, Kamba traditions allowed her to marry another woman who could bear the couple a son.

It was however not the work of Angela’s husband to bed the new wife but his other family relatives.

Angela filed a divorce case in a Machakos court but the judge was unable to rule as there is no constitutional framework on same-sex marriages in Kenya.

Josephine is now troubled as Angela is chasing her.
