CJ Maraga backs the use of CCTV footage as evdence in court

 

Chief Justice David Maraga has said a time has come for courts to be allowed to use CCTV footages as evedence in order to facilitate faster delivery of justice.

Maraga who was speaking during te 20th sitting of the National Council on Administration of Justice asked the judiciary to support and adopt the plea bargains as one of the methods to be used in dealing with the  burden of cases in courts.

“We need to have an open and honest discussionon how  to deal with the issues in the commercial justice system and criminal sector relating to corruption,”said CJ Maraga.

The CJ acknowledged that there are a lot of delays in the hearing and determination of cases in the courts which is hampering the progress of administering justice in the country thus scaring away potential investors who often feel insecure.

This comes after the Judicary was recently put under pressure by the executive for being sluggish and weak in administering justice. President Kenyatta challenged the Chief Justice to ensure the Judciary is firm and decisive in their excution of justice.

Maraga however, seized the opportunity to refute caims that his recent aggressive decisions in the Judicial system has been orchastrated by the pressure from the excutive.

“Why didn’t they complain when i moved the others? Why these ones? Do they know tha I am trasfering more next week? Refuted Maraga in reference to his recent transfer of five judges to different stations.

The meeting which was also attended by Directorof Public Prosecution Noodin Hajji and other non-State actors resolved to push for changes in the law to allowthe use of evidence from non-traditional sources inclding CCTV.
