Victory for Lamu Senator Anwar Loitiptip as supreme Court upholds election

Reprieve for Lamu Senator Anwar Loitiptip  as the Supreme Court declares that he was validly elected.

The apex court set aside the Court of Appeal ruling that had nullified his election.

The judges ruled that the Court of Appeal erred in law when they determined the matter without a proper notice of motion and also delving into matters of law.

Mr Loitiptip of Jubilee Party was dethroned in July following an appeal against the High Court ruling that upheld his poll win.

The decision was a big win for the petitioner, Mr Hassan Albeity, who vied for the seat on a Wiper Democratic Movement ticket. He cited irregularities in the conduct of the election.

Earlier on Friday, lawmakers Kangogo Bowen (Marakwet East) and Annie Wanjiku Kibeh (Gatundu North) won the cases against their election in rulings delivered at the top court.

Regarding Mr Bowen, Justice Smokin Wanjala said the appeal did not not raise issues of interpretation.On Ms Kibeh’s case, the court said the irregularities cited did not justify annulment.
