How the DCI & DPP’s attempt to gag the fourth estate failed

It’s a big blow for the Director of Public Prosecutions Noordin Haji and the Directorate of Criminal Investigations George Kinoti after the Anti Corruption Court has declined their request to gag the media from covering the Kenya Power and Lighting Company (KPLC) case where former Managing Director Ben Chumo is charged alongside other officials for allegedly looting Ksh. 409 million in faulty transformers tender.

The DPP and DCI has moved to court to raise concern of how the media had painted them in the case as having ‘bungled’ the investigations. Through assistant DPP Alexander Muteti, the two bosses had asked the court to reprimand the media for being malicious in the story covered yesterday.

However, in his ruling Senior Principal Magistrate Felix Kombo ruled that everything that was written in the said newspaper was factual because that’s what their witness said.

Yesterday, Linus Murithi a witness from Public Procurement Regulatory Authority (PPRA) told the Court that the DCI had not presented him with adequate evidence on the case and that is why he came up with the outcome. He further said that had the DCI given him all documents, his findings would have been different as he would have compiled a comprehensive report.

Murithi had a hard time defending the damning report that will be used to convict the top bosses. He also admitted to have flaunted the rules by not seeking the documents and instead depended on those provided by the DCI.

The court also heard that the DCI wrote to PPRA to investigate the tender days after the senior KPLC officials had already been charged and the defense argues that it was fishing for evidence.
