Miguna Miguna clarifies Justice Mwita’s orders in his case

Justice Chacha Mwita on Friday made a ruling in Lawyer Miguna Miguna’s case that might see him jet back in the country.  Miguna Miguna has however this Sunday morning come out to state what Justice Mwita’s orders meant.

Miguna says that the orders are meant to restitute for the injuries President Uhuru Kenyatta and what Miguna termed as “his surrogates” have inflicted on him. He went ahead to state that no matter how much anyone is awarded in damages, it will never restore the physical, emotional, reputational and financial loses any party has suffered. Is Miguna condemning the ruling Justice Chacha Mwita made in his favour?

The Judge in his long awaited ruling , maintained that Miguna Miguna’s rights were violated.

The judge also maintained that Miguna’s freedom and dignity was also violated.

He ruled out that Miguna Miguna is a Kenyan, and that he never renounced his Kenyan Citizenship.

“Miguna Miguna is a citizen by birth; never lost his citizenship by acquiring Canadian citizenship. Respondents had no power to revoke his citizenship. Even if they could, they never acted procedurally,” ruled the Court.

The Court  also ordered the state to pay Miguna Miguna a sum of cash amounting to Ksh 7 million as compensation for continued violation of his rights since he is still in Canada, plus a sum of Ksh 270,000 for the damages caused on his house.

In this case, Interior cabinet secretary Dr Fred Matiang’i and Immigration department head Gordon Kihalangwa are to personally cater for the payments without touching on taxpayers’ money. Do you think the duo will bow down to court orders?
