Grand Mulla Ahmednasir Comes to the Defence of Young Mandera Boy Accused of Treason

Kenya has for the past month been subjected to strange criminal proceedings involving teenagers that just sat for the recently concluded KCSE. From the boys at Ambira to the candidate in Mandera, the country is surely in dire need to address morality among the young generation.

But wait, who is to blame? Is it the parents or the society at large? Many Kenyans feel that the government has played a big role in raising these rogue youths with many claiming that they only copy what they see from the Political leaders and government officials who have continued to thrive by being the chief masterminds of the various rots in the society ranging from corruption, murder and disregard of the rule of law.

The Ambira boys might have been released but the candidate from Mandera is still in Police custody already charged for Treason.

The Candidate was arrested for allegedly planning to kill President Uhuru Kenyatta and Garissa Township MP Aden Duale.  The candidate from Elime Bora Secondary School in Mandera County apparently penned a plot to murder the two leaders on an English Paper One (functional skills) answer sheet.

His paper got the attention of Kenya National Examinations Council (KNEC) officials in Nairobi as they were preparing the exams for marking. The magistrate on his case, Duncan Mtai, ruled that the boy should undergo a mental assessment before the hearing of the case.   The candidate who is facing treason charges is still in police custody.

Top Lawyer Ahmednasir Abdullahi has now come out to defend the embattled candidate. According to Ahmednasir, writing a piece on a plan to kill President Uhuru and Aden Duale is not a criminal offence.

Ahmednasir argues that both the mental planning and actual execution of the plan are absent and therefore no Criminal offence was committed y the KCSE candidate.

The lawyer has called on the Director of Public Prosecutions to declare that the boy is clean and with no criminal offence.

“Writing a piece of prose/fiction on a plan to kill President Uhuru & Hon Duale ISN’T a criminal offence, for both the mens rea(mental part in planning) and the actus reus (the physical actual doing of a crime) are absent. DPP should order that no offence was committed by the boy,” tweeted
