DPP’s new headache for corrupt government officials

Did the Director of Public Prosecutions, Noordin Haji just politely insinuate that there is no competent State Prosecutor in the country that can handle the case against  Deputy Chief Justice Philomena Mwilu? It looks like the DPP has joined the majority of Kenyans who have no hope in the country’s judicial system.

DPP Noordin Haji has today announced the appointment of Queen’s Counsel Khawar Qureshi to lead corruption case against Deputy Chief justice Philomena Mwilu.

Haji said his decision to hire Qureshi was arrived at after he failed to find a suitable candidate through advertisement.

“The DPP advertised for private legal counsel but due to the unique nature of requirements and the complexity of cases, it was not possible to find suitable candidates,” read the statement.

The DPP also noted that the appointment was in line with the Public Procurement and Asset Disposal Act, Article 157 (9) of the Constitution and the Office of the Director of Public Prosecutions Act.

“Taking into account the transnational nature of the offences, the complexity and the special skills required to maintain the integrity of the process, the DPP has deemed it prudent, and has decided to appoint Khawar Qureshi, QC, and his assistants to be consultant and lead prosecution counsel on behalf of the ODPP,” stated the notice on the website of the ODPP.

Mr Haji further explained that because of the nature of the case of the Deputy DJ, a private prosecutor will inject confidence and will look at the law independently, without any external influence.

Queen’s Counsel Khawar Qureshi will now lead the prosecution of corruption cases against judicial and government officials who have in the past managed to walk away scot-free because of the offices they currently hold.

The journey for Philomena Mwilu will not be an easy one especially after Haji accused the judged for compromising the fight against graft in Kenya. The judges have in the recent past expressed their displeasure over the arrest of one of their own and have said that they would fight to defend the independence of the Judiciary.

Mwilu has is facing charged of alleged transactions involving the collapsed Imperial Bank. The embattled Deputy Chief Justice was also charged with various counts among them abuse of office and forgery.
