Speaker Elachi obtains court orders stopping her removal from office

Nairobi County Assembly Speaker Beatrice Elachi has obtained conservatory orders blocking her removal from office pending the hearing and determination of her petition.

Elachi, following her impeachment on Thursday evening, filed a motion certified as urgent at the Employment and Labour Relations Court.

Nairobi City County Public Service Board and the Nairobi City County Assembly were listed as respondents in the motion.

Speaker Elachi further obtained conservatory orders stopping the respondents from appointing a new nominee for approval by the Nairobi City County Assembly for appointment to the office of the Speaker of the House whether in temporary or acting capacity.

“Pending the hearing and determination of this Notice of Motion, a Conservartory Order do issue prohibiting the respondents, their members or any person acting under their behest and direction, from interfering with the execution of the Petitioner of her duties current as the Nairobi City County Assembly Speaker, or otherwise howsoever debating, deliberating upon, or removing from office the Petitioner as the office of the Speaker, Nairobi City County Assembly,” reads the court papers.

“Any purpoted decision to impeach the Petitioner as such Nairobi City County Speaker executed as the 2nd Respondent on the 6th September 2018 be stayed pending the determination of the petition herein.”
